Terms of Use

These terms are an agreement between you and Benjamin Cooney, trading as [trading name, e.g. Vibe DM], ABN [ABN], Yungaburra QLD, Australia ("we", "us"), for using Sunburnt Santa: the iPhone and Android apps, the web game at sunburntsanta.com, and the leaderboards (together, "the game"). By playing you agree to them. If you don't agree, please don't use the game.

1. Who can play

Anyone can play as a guest. To sign in, save scores and appear on the leaderboards you must be 13 or older. If you are under 18, please check these terms with a parent or guardian. Competition prizes have extra eligibility rules in the Competition Rules.

2. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to use the game for your own non-commercial entertainment, on devices you own or control, under these terms and the rules of the store you got it from. The game, its art, music, code and names belong to us or our licensors. You may not copy, sell, modify, reverse-engineer or redistribute the game, except where the law allows it.

The share cards the game makes for you are yours to post on social media for personal, non-commercial use.

3. Your account

• Keep your sign-in secure. You're responsible for what happens on your account.
• One account per person. Don't sell, share or transfer accounts.
• You can delete your account at any time (Me tab → Delete my account, or see Delete your account).

4. Your @handle

Your handle is public: it is shown on the leaderboards. It must not:

• pretend to be someone else, including us, our staff, Santa's official account or another player;
• be offensive, hateful, sexual, threatening or discriminatory, or refer to alcohol or drugs;
• include personal details such as a phone number or address;
• infringe anyone's trade mark or other rights, or advertise anything.

You can change your handle once every 30 days. We may change, hide or remove a handle that breaks these rules, and suspend accounts that keep doing so. Players can report a handle from the Report a problem page.

5. Fair play and conduct

Don't:

• cheat, hack, modify or automate the game, use bots, emulators or scripts, or exploit bugs (please report them instead);
• interfere with our servers, or try to access other players' data;
• create fake or duplicate accounts or fake recruits, or spam people with invite links;
• harass or abuse other players, or use the game for anything unlawful.

Scores only count when our server can replay and verify them. We may remove scores, recruits or points, reset progress, or suspend or close accounts that break these terms. Where it affects a prize, we'll follow the process in the Competition Rules.

6. Points, stars and other in-game items

Christmas points, stars, streaks, badges, elf codes and other in-game items have no money value, can't be sold, traded or exchanged for money, and aren't your property. We may change how they work to keep the game fair and fun.

7. Ads

The iPhone and Android apps show ads from Google AdMob, never during a round. The web game has no ads. See the Privacy Policy and Ads & data notice for how ads use data.

8. Remove Ads purchase

• Remove Ads is a one-off in-app purchase (A$3.99 in Australia; local prices vary) made through Apple or Google, under their payment terms.
• It turns off ads on every device where you're signed in to the same account (or the device you bought it on, if you play as a guest; use "Restore purchase" to get it back).
• It does not change scores, points, rankings or your chance of winning anything.
• Refunds are handled by Apple or Google under their policies. This doesn't limit your rights under the Australian Consumer Law (see section 11).
• If we ever stop running the game, we're not required to keep the purchase working, except as the Australian Consumer Law requires.

9. Leaderboards and competitions

The leaderboards are for fun and bragging rights. Any competition or prize is run only under the Competition Rules, which form part of these terms. If they conflict with these terms about a competition, the Competition Rules win. Prizes are not guaranteed. No purchase is needed to play, compete or win. Apple, Google and TikTok are not sponsors of, or involved in, any competition.

10. Changes to the game

The game is a seasonal advent calendar: doors open on a schedule, and we may add, change or remove levels, features and bonus games, or pause the game for maintenance. We may update these terms; if a change is significant we'll tell you in the app. Continuing to play after a change means you accept the new terms.

11. Australian Consumer Law and our liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.

To the extent the law allows:

• the game is provided "as is" and "as available". We don't promise it will always be available, error-free or that your scores or progress will never be lost (for example because of your device, connection or app store);
• where we are allowed to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again (for Remove Ads, a refund of the price you paid);
• we aren't liable for indirect or consequential loss, or for loss caused by things outside our reasonable control.

If you're a consumer in another country, you may have extra rights under your local law, and nothing here takes them away.

12. Ending things

You can stop playing and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we stop running the game. Sections 2 (ownership), 6, 11 and 13 continue after that.

13. Governing law

These terms are governed by the law of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and courts that can hear appeals from them.
